TERMS AND CONDITIONS OF BOOKINGS OVER THE INTERNET

1. INTRODUCTION

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE.

By using this website, you signify your acceptance of these terms of use. If you do not agree to these terms of use, please do not use this website.

 WWW.BOOKCYPRUS.COM reserves the right, at its discretion, to change, modify, add, or remove portions of these terms at any time.

Please check these terms periodically for changes.

Your continued use of WWW.BOOKCYPRUS.COM following the posting of changes to these terms will mean your acceptance of these changes.

2. GENERAL
A contract concluded on this website will be valid only if the other contracting Party is an adult natural person, having the right to establish a contractual relation, or a registered legal entity having the right to establish a contractual relation as a legal entity.

By using this website, the user accepts financial responsibility for all uses of this website by her/himself and/or other persons using it under her/his responsibility.

These Terms and Conditions provide for the terms of the contractual relation between WWW.BOOKCYPRUS.COM acting as a broker for various suppliers and a client and/or customer using this website and/or purchasing services through it (hereinafter referred to as "the client" or "the customer").

 WWW.BOOKCYPRUS.COM provides accommodation and transport from a wide range of accommodation providers and currier airlines, ships, railways and car rental companies.

The provision of such travel arrangements will be subject to the terms of each supplier as part of the conditions of contract with us (either as agent for the supplier or as part of our holiday package.

All of the suppliers’ terms and conditions cannot be listed here but the client / customer must read them carefully. The main companies that we do business with are listed below but due to the wide range of travel products that we provide, as agent as well as part of our holiday packages, there are many more. The conditions of carriage and/or contract for these suppliers may be found on their own web sites. If it is not possible to find these conditions of carriage and/or contract, contact should be taken with us. 

3. RATES
All rates are in the currency specified each time.  The rates are subject to changes due to currency fluctuations, the increase of VAT or of any other taxes.  Any such increase/decrease will automatically affect the published rates.  The valid rates for any service booked are as published on the WWW.BOOKCYPRUS.COM website at the time of reservation.

4. ITINERARIES AND PROGRAMS
WWW.BOOKCYPRUS.COM reserves its right to modify and/or change, without notice, any itineraries or programs presented in this website, or anything else presented in this website, as a result of changes caused by service suppliers or third persons in general or any other reason.

5. PAYMENT TERMS
Payments for the services chosen and agreed on must be done as displayed within this website and/or system.

By clicking on the "Book now" button after entering your credit card number you are deemed to be submitting a binding offer to the Company.

No contractual or other obligations will be created for WWW.BOOKCYPRUS.COM, unless payment in full is received by WWW.BOOKCYPRUS.COM for all the services to be provided to the customer/ client and agreed on through this website.

WWW.BOOKCYPRUS.COM reserves the right to enable/disable its prepayment option in this web site. The percentage quote of prepayment will be shown on this web site or during the payment process of the Partner Company and/or customer. WWW.BOOKCYPRUS.COM reserves the right to increase/decrease the prepayment percentage quote at any time.

6. CANCELLATION
Cancellation for all other services other than flights made at least 30 days away are subject to a 10%  cancellation fees if the total amount of the reservation has been paid in full or 100% cancellation fees if the reservation has been prepaid.

Cancellations made within 30 days before the initial date of the reservation, or at any point during the duration of the booking, will be subject to full cancellation charges which correspond to the total amount prepaid or paid for the booking. Any lesser charges are subject to the discretion of WWW.BOOKCYPRUS.COM, and after discussion with the affected partner.

In the event of a confirmed booking being unavailable, WWW. BOOKCYPRUS.COM will endeavour to offer an Alternative solution of the same or higher standard in same location or manner. In the event where this is not possible WWW.BOOKCYPRUS.COM may offer a full refund if this Alternative solution is not preferred. WWW.BOOKCYPRUS.COM will also endeavour to contact the Partner prior to the client’s departure and advise him/her of this unavailability. In the case where this is not possible WWW.BOOKCYPRUS.COM will endeavour to ensure that the relevant supplier looks after any changes as quickly and as efficiently as possible.WWW.BOOKCYPRUS.COM  reserves the right to cancel a reservation in the event of system error, system malfunctions and or price calculation error.

7.  STAR RATINGS AND QUALITY OF ACCOMMODATION
The client/customer/partner acknowledges that star and any other ratings are merely a general outline based on the official rating of Cyprus (governed by the Cyprus Tourism Organization)  and may not be relied up on to identify the quality of the accommodation. Standards can vary within the classifications, and this is usually reflected in the price

The same applies for amenities offered and contracted such as: Single rooms, baby cots, roll down or pull out, or extra beds and any other amenities described.

8. ACCURACY OF INFORMATION
WWW.BOOKCYPRUS.COM and its suppliers have taken reasonable care to ensure that the content of the website including all hotels and other information are accurate.

The hotel and other information provided are listings provided by relevant suppliers. WWW.BOOKCYPRUS.COM publishes such information in BONA FIDE.

THE PARTNER ACKNOWLEDGES AND ACCEPTS THAT WWW.BOOKCYPRUS.COM CANNOT BE HELD RESPONSIBLE FOR ANY INACCURACIES IN SUCH INFORMATION, NOR CAN LIABILITY BE ACCEPTED FOR CHANGES TO FACILITIES WHICH ARE NOT NOTIFIED TO WWW.BOOKCYPRUS.COM BY THE RELEVANT HOTEL AND OTHER SUPPLIERS IN QUESTION.

THE CUSTOMER/CLIENT/PARTNER ALSO ACKNOWLEDGES THAT: (I) WHILE WWW.BOOKCYPRUS.COM ENDEAVOURS TO KEEP ACCURATE AND UP-DATED ALL INFORMATION CONTAINED ON THIS WEBSITE, WWW.BOOKCYPRUS.COM CANNOT BE RESPONSIBLE FOR ERRORS, OMISSIONS, OR MISLEADING INFORMATION CONTAINED IN THE HOTEL OR OTHER LISTINGS OR INFORMATION, AND (II) THE HOTEL OR OTHER LISTINGS MAY CONTAIN ERRORS.

9. RESTRICTION OF LIABILITY
Any exclusion or limitation of liability of Air Carrier shall apply to and shall cover all agents servants and representatives of the Air Carrier and any person whose aircraft is used by the Air Carrier for carriage and its agents, servants and representatives

WWW.BOOKCYPRUS.COM will not be liable for any damages or injury caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure.

WWW.BOOKCYPRUS.COM will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this website, even if there is negligence, or if WWW.BOOKCYPRUS.COM or an authorized WWW.BOOKCYPRUS.COM representative has been advised of the possibility of such damages, or both.

In all cases, WWW.BOOKCYPRUS.COM total liability for all losses, damages, and causes of action (in contract, tort including without limitation, negligence), or otherwise will not be greater than the amount paid to access this website and/or its services.

10. FLIGHTS
All contracts for flights concluded through WWW.BOOKCYPRUS.COM are governed by Cyprus Law, E.U. Regulation 261/2004 of 11 February 2004, and the Rules set out by the International Air Transport Association as revised from time to time Clients/ passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin or other than a E.U. Member- State, are advised that the provisions of a treaty known as the Warsaw Convention of 1929 may be applicable to the entire journey, including any portion entirely within the country of origin or destination.  The Courts of the Republic of Cyprus have absolute jurisdiction for all contracts concluded hereby.

All provisions provided in the terms and conditions 1-26 apply to the bookings of flights as well except when in conflict with the provisions of the present section 10.

Definitions:

Air Carrier: air transport undertaking with a valid operating licence.
Operating Air Carrier: air carrier that performs or intends to perform a flight under a contract with a passenger or on behalf of another person, legal or natural, having a contract with that passenger.    
Package: pre arranged combination of not fewer than two of the following when sold or offered for sale and when the service covers a period of more than 24 hours or includes overnight accommodation: (transport, accommodation, and other tourist services not ancillary to the former two).

Denied Boarding: means a refusal to carry passengers on a flight, although they have presented themselves for boarding except where there are reasonable grounds to deny them boarding, such as reasons of health, safety or security, or inadequate travel documentation.
Cancellation: means the non-operation of a flight which was previously planned and on which at least one place was reserved.

Tickets

Ticket is a valid document giving entitlement to transport, or something equivalent in paperless form, including electronic form (E-Ticket), issued or authorized by the air carrier or its authorized agent.
Validity:  Tickets as a general rule are valid for one year, starting from the date issued, except when otherwise provided expressly in the tickets or in Air Carrier’s     tariffs, conditions of carriage, or any relevant regulations.

Name changes:  Not permitted

Other changes: Whether changes or cancellations can be made depends on the fare conditions of the specific ticket bought.  Please contact us at least 3 working days prior to your departure date and before attempting to make any changes or cancellations.

An administration fee of  EUR 20 per ticket will apply to this service in addition to any charges applied by the airline.

Courier delivery/ postal charge may apply.

Air Carriers reserve the right to modify the flight schedule at any time prior to departure.

Name of the Air Carrier:
The Air Carrier’s full name and its abbreviation must appear in Air Carrier's tariffs, conditions of carriage, regulations or timetables. The Air Carrier's name may not appear in full on the ticket, but it must be abbreviated.

Address of the Air Carrier on the Ticket:
The address of the Air Carrier shall be deemed to be the airport of departure as indicated next to the first abbreviation of carrier's name in the ticket. The agreed stopping places are those places indicated in this ticket or as indicated in carrier's timetables as scheduled stopping places on the passenger's route. Carriage to be performed hereunder by several successive carriers shall be considered   as a single operation.

Limitation of baggage Liability
Liability for delay, loss or damage to baggage shall be borne entirely by the Air Carrier and is limited unless a higher value is declared in advance and additional charges are paid. For specific types of articles excess valuation may be declared in cooperation with the Air-Carrier. Some Air Carriers exclude liability for fragile, valuable or perishable articles. In the case of a damaged baggage and within a period of 7 days from the day of the receipt of the baggage, the Client-Passenger must file his/her complaint in writing and must be addressed to the Air Carrier. In case of delay of baggage, the complaint must be made within 21 days from date the baggage was delivered.

11. COMPLAINTS
Should the customer have reason to make a complaint, the complaint must be made and a remedy requested immediately on location to the office referred to in the confirmation. The right to raise claims is invalidated if a participant omits to notify a defect on location.

12. DUTY TO COOPERATE
In the event of disruption to the Services provided each participant is obligated in the framework of statutory regulations to cooperate in avoiding or minimising possible damage.

These terms and conditions are subject to the Laws of the Republic of Cyprus and to the exclusive jurisdiction of the courts of the Republic of Cyprus.

16. FORCE MAJEURE
If as a consequence of Force Majeure,
WWW.BOOKCYPRUS.COM is obliged to curtail, Alter or cancel a booking and/or any services agreed, the partner and/or client/customer shall not be entitled to claim compensation for any loss arising as a consequence of the said curtailment, alteration or cancellation.

The term “Force Majeure” includes but is not limited to acts of God, natural disaster, fire and any other destruction of any accommodation booked, riots, acts of civil or international war, natural disasters, fires, exercise of municipal, legislative, military or other authority, strikes, industrial action, or any other reason beyond the control of WWW.BOOKCYPRUS.COM.

17. AMENDMENT TO THESE TERMS AND CONDITIONS
WWW.BOOKCYPRUS.COM reserves the right to amend these Terms and Conditions at any time.

This Agreement cannot otherwise be altered without prior consultation and agreement with WWW.BOOKCYPRUS.COM.

18. ENTIRE AGREEMENT
These Terms and Conditions contain the entire agreement between
WWW.BOOKCYPRUS.COM and the Client and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified unless expressly agreed by WWW.BOOKCYPRUS.COM in writing.

19. SYSTEM INTEGRITY
The usage of any device, routine, or software which inhibits or interferes with the running of the
WWW.BOOKCYPRUS.COM website or any booking concluded upon it is strictly prohibited.

Any action which creates a load on WWW.BOOKCYPRUS.COM or infrastructure which may be considered unreasonable or disproportionate is strictly prohibited.

20. NO GUARANTEE OF CONTINUOUS ACCESS TO THIS WEBSITE
WWW.BOOKCYPRUS.COM does not guarantee continuous access without  interruption to its website, nor does WWW.BOOKCYPRUS.COM guarantee secure access to its services.

The performance of WWW.BOOKCYPRUS.COM may be interfered with many factors outside its control.

21. HEADINGS
The headings used in these terms and conditions are included for convenience only and shall not define, extend, limit, or otherwise affect these terms and conditions.

22. EXTENT OF VALIDITY OF TERMS AND CONDITIONS
Any Party buying services from this website acknowledges that the provision and the purchase of such services are done according to these Terms and Conditions.

23. ASSIGNMENT IS NOT ALLOWED
The Partner/client/customer may not assign, subcontract convey or delegate his/her rights and obligations under these Terms and Conditions.

24. USE OF PERSONAL INFORMATION
The person purchasing and/or booking services from this website agree that  these Terms and Conditions are reasonable.

The user consents to the use of his personal information by WWW.BOOKCYPRUS.COM and/or the owner of this website and/or its third party suppliers for the purpose of providing the services contracted.

25. MISCELLANEOUS
The user agrees that no joint venture, partnership, employment, or agency relationship exists with
WWW.BOOKCYPRUS.COM and/or the owner of this website as a result of the use of this website or the purchase and/or booking of services through this website.

26. RESERVATION AMENDMENTS
Reserveration amendments will be charged at 20 euros per booking.

Severability:
The invalidity of one or more provisions of these Terms and Conditions does not signify the invalidity of the whole Terms and Conditions.

27. CAR HIRE
1.  Liability to third parties (excluding the passengers in the Car Hire vehicle) for death or personal injury up to Euro 3,400,000.
2. Material damages to third parties (excluding the Car Hire vehicle) up to Euro 85,500.

Additional Charges
 
None of the insurances cover damages or breakage to tires, mirrors, windscreens or any car parts underneath the vehicle.

1. Minimum Rental: one day. Every hour over 25 hours is calculated in excess of one-day rate.

2. Gasoline: The cost of fuel is on the renter’s account. Cars are delivered full of fuel, and the cost of a full tank is payable in advance by the customer at the time of car collection. The car can be returned with a full tank, whereupon a refund will be made on the client’s credit card. No partial refunds will be given.

3. Theft Protection (T.P.): Included in the CDW Insurance with the same excess.

4. Traffic fines: All traffic fines resulting from violation of the Cyprus traffic laws are paid by the customer and are on the renter’s account.

5. Equipment: Baby/child seat and snow chains are available upon request with a daily charge of Euro 3.50 - plus VAT paid locally.

6. Collection / Delivery:

Free of charge to all stations of in town.
From / to hotels in town: within 20km of a Sixt Location free of charge otherwise Euro 9- plus VAT each way paid locally.
Night / after hours (21.00 - 07:30): Euro 9- plus VAT at airports paid locally.
Airport Fee: Euro 13.04 per car rental paid locally.
Rent it Here-Leave it There’’ Service: Requires an advanced written authorization and costs Euro 17 - plus VAT paid locally.
Paragraphs 1 to 6 are subject to: VAT 15%
Reservations have to be made according to Group type and not according to car model.  All pre-booked reservations have to be made according to Group category.  Vehicles shown are only examples of vehicles available. Bookcyprus reserves the right to change these groups and types at any time without prior warning.

7. Maximum Length of a single reservation will be not more than 28 days.

Driver’s Qualifications

To rent a car the driver must:

Be over 25* years of age to qualify for all car groups minimum two years full drivers license. For drivers between the ages of 21 and 25 a full driver’s license must have been held for at least 3 years. Drivers between the ages of 21 and 25 are excluded to drive from groups CTMR (Group J) where the minimum age must be 26 and over.
Have a valid European Union, or International (for countries that do not belong to the E.U.) driving license held for at least two years.
And hold a valid personal credit card for payments.

Other terms of rental

Across the buffer zone rental: Not allowed. The vehicles cannot be used to cross any check/cross point and cannot leave the geographical area under the control of the Republic of Cyprus.

Vouchers

All clients, who have asked for a pre-booked car, must be in possession of a corresponding Voucher, appropriately filled in with all the necessary information according to the reservation, and specifying the services included in the Voucher.  By presenting this voucher upon arrival, the client will receive the car as reserved.
Clients holding no Voucher will be charged by “Sixt Rent A Car” at the retail rates according to the official price-list and payment of their bill must be made locally. At check out, the client must pay all extra charges that are not included in the Voucher.

Getting Around

Unfortunately, public transport on the island has not been able to keep pace with the rapid development of the road network and the contemporary lifestyle of the island.  While various plans to improve and expand the public transport system are being seriously reviewed with EU support in order to reduce road congestion, control pollution and conserve energy, for the time being the options are limited.  If your time on the island is tight, or you are interested in locations off the main routes, the best way to travel around Cyprus is by hiring a car.

The main road network is clearly signposted but a detailed and up-to-date map is something every driver should have in his glove compartment at all times.  If in doubt, do not hesitate to ask for directions.  Consult a fellow driver or any passerby to save precious time.

Visitors will quickly discover that most Cypriots speak English and all are friendly and happy to direct you to your destination.

Driver's Guide

To be permitted to drive in Cyprus you must hold a valid international driving licence or a national driving licence, provided it is valid for the class of vehicle you wish to drive.  Visitors often decide to drive themselves in order to be able to visit the more beautiful, remote areas and places of interest that are not accessible by public transport.

Traffic moves to the LEFT-hand side of the road, NOT on the right.
International road traffic signs are in use and placed along the roads and highways on the left-hand side.
Distances and speed limits are posted in kilometres and kilometre-per-hour (km/h) respectively.
The maximum speed limit on the motorways is 100 km/h and the maximum speed is 65 km/h.  On all other roads the speed limit is 80 km/h unless a lower one is indicated.  As a rule the speed limit in built-up areas is 50 km/h unless otherwise indicated.
The use of seat belts is compulsory (front & back).
Passengers 12 years and older with a height over 1.5m must wear seat-belts in the front or back seats of the car.
Children under the age of 12 or less than 1.5m in height must wear a suitable safety belt or be restrained with a suitable restraint system.
Rush hours in town are roughly between 07:30 – 08:00 / 13:00 – 13:30 and in the late afternoon 17:00 – 18:00 in winter or 18:00 – 19:00 in the summer.
It is advisable to avoid, if possible, driving due west in the late afternoon, as the glare of the setting sun can be unpleasant and potentially dangerous.
Due to the sometimes intense brightness of the clear Mediterranean sky, drivers are advised to wear sunglasses.
Driving under the influence of alcohol
 
Driving or being in charge of a motor vehicle with an alcohol concentration in the breath or blood above the prescribed limit is an offence.  The permissible limit in the blood is 50 milligrams of alcohol in 100 millilitres of blood.  The permissible limit in breath is up to 22 micrograms of alcohol in 100 millilitres of exhaled air.

Be sure to that you are covered by insurance for injury or damages.
Names of places

The good thing about road signs in Cyprus is that names are written in both Greek and English.  However, this convenience is not without its problems.

When referring to a place in English, there are still two schools of thought; those who maintain the traditional English name, and others who follow a more recent decision to transliterate the original Greek name.  Some signs actually provide both.  Once you’ve seen a few signs you are likely to understand the system.  The below table is a guide to assist you to understand the names & spelling of the areas in Cyprus:
